Had Sex On A Beach? That Ain't Private, Brazilian Judge Tells Cicarelli In YouTube Case
YouTube wins "supermodel sex on the beach" case from Ars Technica reports that Brazilian model Daniella Cicarelli and her boyfriend have lost their case against Google's YouTube.
Cicarelli and her boyfriend were videotaped having sex on a public beach. The video made its way around the internet, airing on popular Brazilian TV shows and finally ending up on YouTube.
YouTube tried to delete all the videos that were uploaded, but they could not keep up with all the users uploading copies of that video. Cicarelli sued and won against YouTube for invaliding their privacy. Brazil shut down YouTube in that country, as a result, but it was then reopened after a court overruled the initial verdict.
On Cicarelli's claims of invading her privacy, a court has now ruled that since her actions were in public, she couldn't claim to expect them to be kept private. The court ruled that Cicarelli had to pay court and legal fees, plus pay Google about $5,000.
